In Brief
The appellant corporation sought to overturn an Industrial Tribunal award directing reinstatement of the respondent, an employee at a closed automobile workshop unit. The respondent had worked on a limited-period appointment that ended when the unit shut down in August 1999. The Supreme Court held that reinstatement was not justified where the employing unit no longer existed and the respondent had already started his own denting workshop business. The Court set aside the High Court's order and instead awarded the respondent Rs. 2.50 lakhs as compensation in lieu of reinstatement and backwages, based on comparable settlements given to similarly situated employees.
