PUNJAB URBAN PLANNING AND DEVELOPMENT AUTHORITY vs KARAMJIT SINGH

Bench: 2 — Uday Umesh Lalit, Indu Malhotra

In Brief

The Supreme Court set aside a High Court order directing reinstatement of a daily-wage worker whose services had been regularized through fraudulent interpolation of his name in the final list of recommended employees. The respondent did not meet the policy requirement of three years' continuous service and produced no evidence to support his claim. The Court held that appointments obtained through fraud are void ab initio and place the person outside statutory protections. Since no valid employment relationship existed, disciplinary regulations did not apply, and termination by the Authority was lawful. The respondent received a costs deposit only.
