Rajnish Kumar Mishra & Ors. etc vs State of Uttar Pradesh & Ors. etc

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

Rajnish Kumar Mishra and others challenged the High Court's decision upholding the District Judge's annulment of their regularization order. The Supreme Court held that the successor District Judge violated natural justice principles by cancelling the regularization without giving the employees a hearing. Since similarly situated employees were granted regularization and the amended rules provided for a one-time regularization for those with 10 or more years of service, the appellants were entitled to the same benefit based on statutory parity and procedural fairness. The appeal was allowed.
