In Brief
A property buyer sought specific performance of a 2005 agreement of sale for Rs. 30 lakh, having paid Rs. 12.5 lakh as earnest money. The trial court granted specific performance, but the High Court set aside this decree, finding the buyer failed to prove he was always ready and willing to perform. The Supreme Court dismissed the appeal, holding that a plaintiff must not only aver readiness and willingness but must also provide documentary evidence of fund availability. Both readiness (financial capacity) and willingness (conduct) are essential for specific performance relief.
