Rachna sought transfer of a matrimonial petition filed against her by her husband Ashok from the District Court at Ambah, Madhya Pradesh to the Family Court at Saket, New Delhi. Rachna, the respondent, resides in Delhi, approximately 800 km from Ambah, making it impractical for her to travel there to defend the case. The respondent was served but did not appear with counsel. The Supreme Court held that, considering the distance and resulting hardship, it was just and appropriate to transfer the matrimonial petition to the Family Court in New Delhi. The petition was allowed."
