Rachna, a wife resident in Delhi, sought to transfer a matrimonial case filed by her husband Ashok in a district court in Ambah, Madhya Pradesh (about 800 km away) to the Family Court in New Delhi. The Supreme Court, considering the hardship of travelling such a distance to defend the case and the appropriateness of family courts for matrimonial matters, transferred the case under Section 25 of the Code of Civil Procedure and Section 9 of the Hindu Marriage Act. The petition was allowed.
