Radha Bai vs Ram Narayan & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Radha Bai appealed against the dismissal of her claim to ancestral property. The Supreme Court upheld the High Court's decision that the property devolved equally upon her grandfather's two sons, Janakram and Pilaram, who later partitioned it. As Radha Bai's father had predeceased the original owner and never acquired a share, he could not pass ancestral property rights to her. The Court held that a daughter cannot claim rights superior to those her father possessed, and she cannot inherit from property her father never owned. The appeal was dismissed accordingly."
