The Supreme Court considered whether a court could remand an arbitral award back to the arbitrator for fresh consideration under Section 34 of the Arbitration and Conciliation Act, 1996. The original arbitrator had decided that the law of limitation did not bar the claim and awarded Rs. 21,60,440 with interest. In a Section 34 petition, the Single Judge found the limitation issue had not been correctly decided and ordered remand to a new arbitrator. The Supreme Court held that courts have no jurisdiction to remand matters to arbitrators for fresh decisions. The Court set aside both the Single Judge's and Division Bench's orders and remanded the case for the Single Judge to decide the Section 34 petition on its merits.
