Raftaar Media Pvt. Ltd vs Noida Software Technology Park Ltd

Bench: 2 — <UNKNOWN>

In Brief

Raftaar Media, a news broadcasting company, had an agreement with Noida Software Technology Park for uplink and transponder services. When Raftaar defaulted on monthly payments (Rs 4.8 lakh), the services were disconnected. Raftaar challenged the disconnection before TDSAT, seeking reconnection and damages. TDSAT upheld the disconnection as justified and rejected the damages claim, but awarded the respondent outstanding dues of Rs 25,60,006 with 18% interest. The Supreme Court affirmed TDSAT's findings but reduced the interest rate to 12% per annum considering the appellant's financial position. The payment was ordered within eight weeks.
