Raftaar Media Pvt. Ltd vs Noida Software Technology Park Ltd

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Raftaar Media, a news broadcaster, contracted with Noida Software Technology Park to receive up-linking and transponder services at Rs.4,80,000 per month. When Raftaar defaulted on payments, the respondent disconnected services. Raftaar approached TDSAT seeking reconnection and damages; the respondent countered for outstanding dues (Rs.25,60,006/-) with 18% interest. TDSAT upheld the disconnection as justified and contractually valid, rejecting Raftaar's damages claim. The Supreme Court confirmed TDSAT's findings but exercised discretion to reduce the interest rate from 18% to 12% per annum, considering Raftaar's financial condition. The appeal was disposed accordingly."
