The appellant sought to resume 4 acres of land from tenants under the Mysore Land Reforms Act, 1961. A compromise deed was entered into between the parties before the Munsiff/Tribunal on 2 March 1970, wherein the tenants agreed to surrender the land and possession was transferred to the landlord. The High Court set aside the resumption on the ground that possession was not handed over strictly according to Section 14(5) procedures. The Supreme Court held that where a binding compromise is acted upon by actual transfer of possession, strict procedural formalities need not be mechanically repeated. The appeal was allowed as the substantive requirement—actual possession—had been undisputedly satisfied.
