Raj Saini vs State of Haryana and Anr. Etc

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Dr. Raj Saini accused her estranged husband Dr. Parkash Saini and others of criminal trespass, wrongful restraint, criminal intimidation, and property damage. An incident at a jointly-held nursing home was captured on CCTV showing the accused breaking open a door and damaging property while threatening violence. The initial investigation omitted the CCTV evidence and charged only minor offences. After fuller investigation, serious sections including sections 455 and 427 IPC were added. The Sessions Court dismissed the accused's anticipatory bail application. The High Court reversed this, granting bail. The Supreme Court set aside the High Court's order, holding it failed to consider the nature and gravity of charges and the clear CCTV evidence of the accused's direct involvement in the criminal acts.
