Rajasthan High Court, Jodhpur & Anr vs Neetu Harsh & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Neetu Harsh applied for Rajasthan Judicial Examination posts in the general category, but later claimed she was 80% visually impaired and sought appointment from vacancies reserved for differently abled persons. The High Court directed her consideration under the PWD category. The Supreme Court allowed the appeal, holding that once an appointment is complete in the general category, it cannot be disturbed by a subsequent representation claiming PWD status. While disabilities deserve employment protection as a right, candidates must claim such status at the appropriate application stage.
