RAJASTHAN HIGH COURT JODHPUR vs NEETU HARSH

Bench: 2 — R. Banumathi, A.S. Bopanna

In Brief

The Supreme Court set aside a High Court order directing the Rajasthan High Court to consider a candidate for appointment under the reserved category for disabled persons in a judicial recruitment. The candidate had applied as a General Category candidate, paid the general examination fee, and made no disability claim in her initial application. Only after the merit list was published did she request consideration under the disability category. The Court held that a candidate cannot change their applied category or claim disability status after examination stages are complete, and must submit relevant documents and claims at the time of application. The Court also upheld Rule 10(4) of the Rajasthan Judicial Service Rules, allowing unfilled reserved vacancies to be filled from the general merit list rather than carried forward.
