Respondent No. 1, a coach employed by the Rajasthan State Sports Council, sought promotion to Sports Officer for vacancies occurring in 2003–2004. The High Court set aside the initial promotion decision of another candidate (respondent No. 2), holding that the 2006 Rules introducing seniority-cum-merit criteria could not apply to pre-2006 vacancies. The Supreme Court allowed the appeal, holding that while a candidate has no vested right to promotion, they have a right to be considered under rules in force when the promotional case is taken up. Vacancies occurring before 2006 must be filled under the seniority criterion applicable then, not the 2006 amended rules.
