Uma Dadhich, a Sports Council employee, sought promotion to Sports Officer for vacancies arising in 2003-2004. Nine persons were promoted in 2009 under the 2006 Rules (seniority-cum-merit), but the High Court directed reconsideration using the pre-2006 criterion (seniority alone). The Supreme Court held that employees have no vested right to promotion—only a right to be considered under the rules existing when the promotional case is taken up. Since vacancies were actually filled in 2009, the 2006 Rules applied. The Court allowed the appeal and set aside the High Court's direction.
