Rajesh Rekwar vs State (NCT of Delhi)

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

On 14 August 2004, two men were found murdered at a Delhi residence with multiple injuries from sharp weapons. During investigation, appellant Rajesh Rekwar was arrested. At trial, he was convicted under sections 302, 34, and 380 IPC. On appeal, the High Court upheld the conviction. The Supreme Court dismissed Rekwar's special leave petition, holding that the appellant's left thumb fingerprint matched the crime scene evidence, establishing his presence. Although minor discrepancies existed in the Malkhana register dates and unexplained fingerprints were found, the complete chain of circumstances—including recovered car keys, flat keys, injuries on the accused, and refusal to undergo identification parade—proved guilt beyond doubt. The appellant's bail was cancelled and he was directed into custody."
