Rajeshwar Mahto vs Alok Kumar Gupta, G.M. M/s Birla Corporation Ltd

Bench: 2 — Abhay Manohar Sapre

In Brief

An employee of Birla Corporation Ltd. whose services were terminated in 1985 fought an industrial dispute spanning over two decades. While the Supreme Court ultimately upheld the Corporation's position in the main appeal, it held that an interim order passed under Section 17-B of the Industrial Dispute Act (requiring payment of subsistence allowance) remained independently enforceable and valid. The Court awarded the employee Rs. 7,50,000 as full and final settlement of all claims, payable upon vacating the company quarter within three months. The decision clarifies that interim reliefs under Section 17-B survive final judgments and remain enforceable independent obligations on employers."
