Ram Chander (dead) Thr Lrs vs Union of India

Bench: 2 — M.R. Shah

In Brief

In this land acquisition case, the Supreme Court set aside the High Court's decision to recall an earlier compensation award on review. The original 2001 judgment awarded compensation of Rs. 2240/- per sq. yard based on the Bhola Nath precedent. The High Court later allowed review petitions on the ground that Bhola Nath had been set aside and remanded. However, the Supreme Court found this ground no longer valid because by 2017, the remanded Bhola Nath case had been re-decided upholding the same compensation level, and the subsequent SLP was dismissed. Therefore, the original judgment was restored, requiring the landowners be paid the 2001 award plus statutory benefits within twelve weeks.
