SH. RAM CHANDER (DEAD) THR LRS vs UNION OF INDIA

Bench: 2 — M. R. Shah, B. V. Nagarathna

In Brief

Land was acquired in village Jasola, Delhi under the Land Acquisition Act, 1894. The Land Acquisition Officer awarded Rs. 3,500 per bigha; the reference court raised it to Rs. 22,000 per bigha. The High Court enhanced it to Rs. 2,240 per square yard in 2001, relying on the Bhola Nath judgment. Years later, when the Bhola Nath decision was set aside by the Supreme Court and remanded, the High Court allowed review petitions and recalled the 2001 judgment. However, by the time the review was decided, the High Court had already decided Bhola Nath on remand, reaffirming similar compensation (Rs. 2,000/sq. yd.), which the Supreme Court upheld by dismissing the appeal. The Supreme Court quashed the review orders, finding their statutory ground had ceased to exist, and restored the original 2001 judgment awarding Rs. 2,240 per square yard.
