Rama Devi Nayar vs State of Rajasthan and Another

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court heard an appeal against bail granted by the Rajasthan High Court to Mukesh Chaudhary, accused in a murder case arising from a love marriage. The deceased was killed by unknown persons at the appellant's house during an attempt by the victim's parents to force his wife to leave. The accused was charged with conspiracy to commit murder (IPC Sections 302, 452, 120B). Finding prima facie material of the accused's involvement—including that his parents visited his residence after the crime and the murder weapon was concealed there—the Court cancelled the bail and directed the accused to surrender, holding that bail should not be extended pending trial when substantial evidence of involvement exists."
