Rama Devi Nayar vs State of Rajasthan and Another

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A woman complained that her son was killed in an honour killing orchestrated by her daughter-in-law's family, including the respondent-accused. The High Court had granted bail to the accused. The Supreme Court, on special leave, cancelled the bail after finding prima facie evidence of the accused's involvement in the crime—particularly that the murder weapon vehicle was hidden at his residence and his parents visited him after the alleged crime. The Court held that in serious offences like murder with conspiracy, bail should not be extended when material exists against the accused, and remitted the case for trial."
