Rama Nand Singh vs State of Bihar

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Rama Nand Singh was convicted of murder (Section 302/34 IPC) alongside his father Ram Kumar Singh for causing the death of Hit Lal Singh during a field altercation. While the co-accused inflicted the fatal stab wound, Rama held the deceased. The High Court upheld the conviction. The Supreme Court found that although eye-witnesses proved the facts reliably, the nature of participation—an impulsive act in heat of the moment—warranted downgrading to culpable homicide not amounting to murder (Section 304 Part II/34). The conviction was modified and the sentence reduced from life imprisonment to seven years rigorous imprisonment.
