A property dispute between siblings escalated into criminal charges of forgery. The original owner (Shyam Lata) alleged her brothers forged her signature on a rent receipt to falsely claim tenancy. After initial investigations were stalled due to procedural issues, the Sessions Judge ordered further investigation including expert examination of signatures. However, the High Court simultaneously passed two contradictory orders: one allowing modified investigation and another setting it aside entirely. The Supreme Court held that the contradictory orders had to be reconciled, the further investigation was lawful and necessary, and the Magistrate's cognizance on the resulting chargesheet should proceed. The appeals were allowed and criminal proceedings restored.
