In Brief

Two neighbouring farmers owned adjoining agricultural land. The defendant's land was remeasured in 1991 and found to exceed its original documented area by 1.07 hectares. The plaintiffs obtained a Sub Divisional Officer's order correcting the revenue record to restore the original boundary. When the defendant enclosed the disputed land with wire fencing, the plaintiffs sued for possession. All lower courts found the defendant had encroached and awarded possession to the plaintiffs. The Supreme Court dismissed the defendant's appeal, holding that the official boundary map retained evidentiary value despite the S.D.O.'s order being later set aside, and that civil courts have clear jurisdiction to resolve such encroachment disputes under land revenue law.
