In Brief

The parties owned adjoining agricultural land in Maharashtra. The plaintiffs claimed the defendant encroached by erecting wire-fencing on their field. After the plaintiffs obtained a Sub Divisional Officer's order to correct revenue records to restore their field's original boundary, they filed a civil suit for possession. The trial court and all appellate courts found encroachment and decreed possession in favour of the plaintiffs. On appeal, the defendant challenged the admissibility of a revenue map used as evidence and contended that civil jurisdiction was barred. The Supreme Court held that revenue maps retain evidentiary value despite subsequent reversal of the directing order, and that civil courts have clear jurisdiction to entertain possession suits. The appeal was dismissed."
