Supreme Court of India 2019-07-22 dismissed

Ramesh Das (Dead) Thr. Lrs vs State of Madhya Pradesh & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court dismissed a civil appeal challenging a High Court order that upheld dismissal of a property dispute. The plaintiff-appellant claimed ownership of land and a temple built on it, asserting he was the property's owner and the temple's priest. However, official revenue records (Bandobasti Khasra) showed the land was designated as 'Inam Devasthan' (temple property), with the plaintiff's ancestors registered only as managers, not owners. The lower courts accepted these findings, and no evidence demonstrated the records were wrong. The Court held that concurrent findings of lower courts cannot be re-examined unless shown to be perverse, and dismissed the appeal.
