Ramrao Lala Borse and Anr vs New India Assurance Company Ltd. and Anr

Bench: 3 — D.Y. Chandrachud

In Brief

A 29-year-old assistant teacher working temporarily died in a motor accident. The High Court awarded Rs. 26.45 lakh using a multiplier of 7 based on the parents' age. The Supreme Court reversed this, holding that the correct multiplier should be 17, based on the victim's own age and life expectancy under established law. Applying the multiplier of 17 with 50% added for future prospects and 50% deducted for personal expenses, the Court enhanced compensation to Rs. 61.90 lakh, holding that multipliers are determined by the victim's age, not the dependants' age.
