Sunita Tokas & Anr vs New India Insurance Co. Ltd. & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A widow and another family member appealed for enhanced compensation following a motor accident death. The deceased was a 21-year-old bachelor. The Motor Accident Claims Tribunal and High Court had awarded compensation using a multiplier of 15, based on the mother's age. The Supreme Court held that unmarried persons should receive the same multiplier treatment as married persons. Since the deceased was 21, a multiplier of 18 applied. Recognizing the young bachelor's earning potential, the Court allowed the appeal and enhanced the compensation accordingly.
