Rathin Ghosh vs West Bengal State Electricity Distribution Company Ltd. & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

An employee of West Bengal State Electricity Distribution Company was suspended for alleged gross misconduct and subsequently dismissed. The Supreme Court held that rather than uphold the dismissal, the appellant's resignation letter should be treated as voluntary retirement. The Court directed the company to recognize the appellant as voluntarily retired and to compute and pay all retirement benefits, including gratuity and pension, to which he was entitled. This approach served the ends of justice by protecting the appellant's statutory rights while acknowledging the disciplinary concerns raised.
