Supreme Court of India 2017-03-21 dismissed

Raval Manharbhai Kalidas and Ors vs Bhaskarbhai Chandubhai Patel and Ors

Bench: 2 — Kurian

In Brief

The appeal concerned modifications made by a High Court to a charitable trust scheme governing a village in Gujarat. The appellants argued that the High Court should have issued a public notice under Civil Procedure Code Order I Rule 8 before modifying the scheme to ensure all affected parties were heard. The Supreme Court agreed that a public notice should have been issued but, rather than remit the matter, directed one to be issued immediately. After no objections were filed following the notice, and noting the High Court had considered prior objections and acted in the trust's best interests, the Court dismissed the appeals and allowed the modified scheme to proceed.
