Ravi alias Ravikumar etc. etc vs State Rep. by Inspector of Police

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court considered whether an appellant (Chandran) should receive the same remission and commutation benefits under section 433 of the Criminal Procedure Code as had already been granted to his co-accused Ravi and Sreekumar. The respondent State contended that Chandran remained under separate prosecution in an unrelated case. The Court held that the cases were independent and found no material difference in the roles or positions of all accused. Consequently, it extended the same benefits to Chandran and ordered his immediate release from custody, while clarifying that his ongoing prosecution in the separate case would remain unaffected.
