Ravi alias Ravikumar etc. etc vs State Rep. by Inspector of Police

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Chandran, an appellant in a criminal appeal, sought the same benefit of commutation and remission under section 433 of the Code of Criminal Procedure that had been granted to his co-accused Ravi and Sreekumar. The State opposed this on the ground that Chandran was being prosecuted in a separate case. The Supreme Court held that since all three co-accused were similarly placed and no material difference existed in their roles, Chandran was entitled to parity in benefits. The Court ordered his immediate release from custody while clarifying that he would remain liable to prosecution in his pending case and face consequences thereof."
