RAVINDER SINGH @ KAKU vs STATE OF PUNJAB

Bench: 2 — Uday Umesh Lalit, Vineet Saran

In Brief

Two children aged 10 and 6 were kidnapped and murdered in 2009. The trial court convicted three accused; the High Court acquitted two but upheld the conviction of Ravinder Singh, sentencing him to 20 years imprisonment. Singh appealed the Supreme Court. The Court held that the conviction, based solely on circumstantial evidence (motive inferred from call records, last-seen theory, and recovery), was legally unsustainable. The High Court's inference of illicit intimacy and resulting motive relied on dubious conjecture without direct evidence and was marred by material contradictions in witness testimony. Additionally, electronic evidence was inadmissible as it lacked mandatory statutory certification. The Court set aside Singh's conviction and ordered his immediate release."
