Ravish and Anr vs R. Bharathi

Bench: 2 — R. Banumathi

In Brief

Ravish and another challenged the High Court's dismissal of their first appeal in a property suit. The respondent claimed ownership of Site No. 4307 based on an allotment letter and sale deed from VHBC Society. The appellants claimed they owned the same property as Site No. 690 under an earlier sale deed from the same society. The High Court dismissed the appeal and directed the appellants to file a fresh suit. The Supreme Court held that when both parties have competing claims supported by registered sale deeds from the same source, the matter should be remitted to the trial court for full adjudication rather than requiring a fresh suit. The Court set aside both judgments and remitted the case to the trial court for hearing on merits."
