Ravish and Anr vs R. Bharathi

Bench: 2 — R. Banumathi

In Brief

Ravish and another appealed against a High Court judgment that dismissed their appeal and directed them to file a fresh suit to establish ownership of disputed land. Both parties claimed the same property through sale deeds from the VHBC Society, but one held a deed for Site No. 4307 while the appellants held a deed for the original Site No. 690. The Supreme Court held that rather than requiring a fresh suit, the High Court should have remitted the matter to the trial court for full adjudication. The Court set aside both judgments, remitted the matter for trial, and directed the trial court to use all available procedural tools—including appointing a Commissioner to investigate site locations—to resolve the ownership dispute on evidence."
