Richard Lee vs Girish Soni and Anr

Bench: 2 — Kurian

In Brief

Richard Lee sought impleadment as a necessary party in an eviction petition affecting a rented shop in Khan Market, New Delhi. He and fellow partners of M/s K.K. Lee claimed to be current tenants carrying on the partnership business, though an earlier 1998 order had found only the individual original tenant liable. The Supreme Court held that the partnership firm and all its current partners are proper parties whose presence is necessary for complete adjudication of the eviction petition under Order I Rule 10 CPC. The Court allowed the appeal, impleaded the firm and partners, and directed the Rent Controller to dispose of the case within six months while maintaining a monthly deposit of Rs. 75,000.
