In Brief
The petitioner sought admission to MBBS at a private medical college through its own entrance examination (CGMAT-2016) conducted in April 2016. The Supreme Court had recalled its 2013 judgment and revived the requirement that NEET was the only permissible mode of admission to medical colleges. The College admitted the petitioner in violation of the prescribed schedule and Supreme Court orders. The Court held that though the petitioner was an innocent victim of institutional maladministration, the rule of law required dismissing his petition. Allowing irregular admissions would undermine judicial supremacy. The petitioner was permitted to pursue remedies against the College and State separately.
