Rojina Begam vs Firoz Munshi & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Rojina Begam, widow of a man killed in a bomb and firearms attack, appealed the High Court's acquittal of four accused persons. The Trial Court had convicted them of murder (Section 302 IPC). The Supreme Court held that the High Court erred in disregarding the testimony of two credible eyewitnesses named in the FIR—one of whom was injured in the attack—whose accounts were consistent and corroborated by medical evidence. Inconsistencies in other witnesses' statements did not diminish the core evidence. The Court set aside the acquittal, restored the conviction, and imposed life sentences. The appeal was partly allowed; six other accused remained acquitted.
