Roma Sonkar appeared in a 2010 state competitive examination but was denied marks for certain answers. Through an RTI application, he discovered answers he had submitted were not awarded marks despite being correct. The High Court's Single Judge granted him appointment with consequential seniority. The Division Bench remitted the matter for relief reconsideration. The Supreme Court held that in writ appeals, the Division Bench must decide matters on merit, not remit them. Finding the PSC conceded he would have been selected with corrected marks, the Court ordered his appointment as Commercial Tax Inspector with seniority from August 2018, deeming him appointed if the order was not issued within four weeks.
