This appeal concerned a civil service examination candidate (Roma Sonkar) who discovered through an RTI application that certain answers had not been awarded marks. The High Court's Single Judge granted relief with consequential appointment and seniority benefits. The Division Bench remitted the matter to the Single Judge to reconsider the relief. The Supreme Court held that in writ proceedings, the Division Bench must decide the appeal on merits rather than remit it. Finding that the appellant would have been selected with the correct marks, the Court ordered his appointment as Commercial Tax Inspector with seniority from 1 August 2018, to ensure complete justice without creating a precedent.
