The appellant, accused of selling cocaine in Chhattisgarh, alleged he was illegally abducted from a hotel in Odisha and falsely implicated by State police. He sought a direction to transfer the investigation to the CBI. The Supreme Court dismissed the appeal, holding that the power to transfer investigation to CBI is extraordinary and must be exercised sparingly only in exceptional cases. The disputed allegations regarding police conduct are matters of evidence to be resolved through normal trial proceedings where the accused can cross-examine witnesses and present his defence. The mere allegation of police misconduct, without establishing public importance or necessity, does not warrant investigation transfer when trial is already in progress.
