S. Bhaskaran vs Sebastian (Dead) by Lrs. & Ors

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

The appellant and his uncle were found by the trial court to be trustees of temple properties. A dispute arose over execution of a decree based on those findings. The revision court revisited the trial court's decision on trusteeship, which the Supreme Court found impermissible. Once trial court findings attain finality, a revision court cannot reopen them. The execution petition seeking to challenge the original decree as fraudulent must be rejected, and the trial court's decision affirmed. The Supreme Court allowed the appeal.
