SACHIN JAISWAL vs M/s HOTEL ALKA RAJE & OTHER

Bench: 2 — Sudhanshu Dhulia, Ahsanuddin Amanullah

In Brief

The Supreme Court upheld the High Court's dismissal of the appellants' claim to property owned by Hotel Alka Raje partnership firm. The appellants sought to claim rights in the hotel property through their deceased father, who had originally purchased the land but later contributed it to the partnership firm when it was established in 1972. The Court held that under Section 14 of the Indian Partnership Act, once a partner brings property into the firm, it becomes the firm's perpetual property. The partner and his heirs have no claim to the property itself, only to the partner's agreed share of profits and partnership assets. The relinquishment deed executed by the deceased partner merely confirmed this legal position and did not affect the firm's ownership.
