This case involved an appellant convicted under the POCSO Act and initially sentenced to seven years imprisonment. The High Court and Special Court erroneously converted this to life imprisonment plus a fine. The appellant had by then served eleven years and eight months in jail. The Supreme Court found the higher courts' orders legally erroneous and set them aside. Exercising its constitutional powers under Article 142 to do complete justice, the Court restored the original seven-year sentence and ordered the appellant's immediate release, since he had already served more time than the original sentence. The appeal was allowed and the appellant released forthwith.
