& ORS vs VERSUS VIJAYATA & ORS

Bench: 2 — B. V. Nagarathna, Satish Chandra Sharma

In Brief

On 13 January 2016, Vijay Jumnalkar was fatally struck by a speeding Bolero vehicle in Belagavi. A minor was held liable for the accident, and compensation of ₹21,82,800 was awarded to the victim's family. The Supreme Court examined the evidence in this appeal and found that the actual driver was the minor's adult father, not the minor himself, who was merely a passenger. The Court absolved the minor of any involvement, upheld the compensation award for the victim's widow and dependents, and held the insurance company liable without recovery from the vehicle owner.
