In Brief
Three sons of an informant were killed in an armed attack by six accused persons in a village land dispute on 4 October 1994. The trial court convicted five surviving accused (two to death, three to life imprisonment) under IPC sections 302/149, 307/149, and 148. The High Court acquitted all without adequate reasoning. The Supreme Court allowed the appeal, reversing the acquittal and restoring convictions to life imprisonment, holding that the trial court's reasoned judgment was sound, the eyewitness evidence was credible despite piecemeal examination, place of occurrence was established by forensic evidence, and the High Court's reliance on minor medical discrepancies was perverse appreciation of evidence.
