The Supreme Court held that the High Court erred by postponing its decision on Miscellaneous Applications filed under Section 7, Rule 11 of the Civil Procedure Code, 1908 pending the disposal of main Election Petitions. The Court set aside the High Court's orders and directed that these procedural applications should be decided independently and promptly—preferably within two weeks—without awaiting the outcome of the substantive election cases. Following disposal of the applications, Election Petitions must be decided within six months. The appeals were allowed.
