In Brief
Three civil appeals challenged the High Court's decision to defer ruling on miscellaneous applications filed under Order 7, Rule 11 CPC (relating to election petitions) pending disposal of the substantive election petitions themselves. The Supreme Court held that miscellaneous applications should be decided independently and expeditiously on their own merits, and not postponed until the main petition is resolved. The Court set aside the High Court's orders and directed that the miscellaneous applications be decided within two weeks, with the election petitions to follow within six months. All three appeals were allowed accordingly."
