In Brief
The Union Territory of Lakshadweep advertised a Junior Engineer (Electrical) post requiring a Diploma in Electrical Engineering. The appellants held Diplomas in Electrical and Electronics Engineering and were selected. Unsuccessful candidates challenged their selection before the CAT and High Court, claiming the qualifications differed. Both tribunals agreed and set aside the appointments. The Supreme Court allowed the appeal, holding that the appointing authority had sought and received clarification confirming the qualifications were equivalent. Courts should not interfere when the employer, after informed assessment, recognizes qualifications as equivalent and there is no glaring difference. The employer, not the court, is the best judge of recruitment eligibility.
